Terms of Service
By using the website, services, or products of Simple Server Networks, customers agree to these Terms, along with the Acceptable Use Policy and Privacy Policy where applicable.
1. Acceptance of Terms
By purchasing or using any service offered by Simple Server Networks, you agree to be bound by these Terms of Service, the Acceptable Use Policy, and the Privacy Policy. If you do not agree, do not use the services.
2. Service Description
Simple Server Networks provides dedicated servers, virtual servers, and Asterisk-powered PBX setups. Services are provided as-is and as-available. While high reliability and performance are intended, services are not guaranteed to be completely error-free or uninterrupted.
3. Billing and Payment
- Payment Terms: Services are prepaid and billed monthly unless stated otherwise.
- Due Date: Invoices are due upon receipt. Unpaid accounts may be suspended or terminated after 48 hours of non-payment.
- Late Fees: A late fee of 5% may be applied to overdue invoices.
- Refunds: Payments are non-refundable unless explicitly stated otherwise.
4. Account Suspension and Termination
Simple Server Networks reserves the right to suspend or terminate services for non-payment, violation of the Acceptable Use Policy, abuse of network resources, or any behavior that jeopardizes the integrity, performance, or reputation of the network. Notice may be attempted before suspension or termination, but it is not guaranteed.
5. Acceptable Use
Services may not be used for illegal or abusive purposes, including hosting malware, phishing, spamming, participation in DDoS attacks, copyright or trademark violations, unauthorized cryptocurrency mining, harassment, or threats. 6. Support and Maintenance
Technical support is provided for network and hardware issues. Support does not include customer-coded applications, software not installed by Simple Server Networks, or unrelated third-party services and scripts. Scheduled maintenance windows may be communicated in advance, while emergency maintenance may occur without notice when critical issues arise.
7. Data and Backups
You are solely responsible for backing up your data. Simple Server Networks is not liable for data loss, corruption, or unauthorized access.
8. Liability and Warranties
All services are provided without warranties of any kind, whether express or implied. Simple Server Networks is not liable for downtime, service interruption, data loss, corruption, unauthorized access, or any direct, indirect, incidental, or consequential damages.
9. Modifications to the Agreement
These Terms may be updated or changed at any time. Continued use of services after changes constitutes acceptance of the updated Terms.
10. Governing Law
These Terms are governed by the laws of the State of South Carolina, without regard to conflict of law principles.
